It states that development in areas at risk of flooding should be avoided by directing development away from areas at highest risk.<\/p><p>However, this is often at odds with both targets for new homes and the availability of suitable development sites. The NPPF makes an allowance for development to occur in flood risk areas if it is considered\u00a0<i>\u201cnecessary.\u201d<\/i>\u00a0Such developments must be made\u00a0<i>\u201csafe for their lifetime,\u201d<\/i>\u00a0without increasing flood risk elsewhere. Similar policies apply elsewhere in the UK, as well as internationally. According to the\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/flood-and-coastal-risk-management-in-england-long-term-investment\/long-term-investment-scenarios-ltis-2019\" target=\"_blank\" rel=\"noopener\">Environment Agency<\/a>, if development in flood risk areas in England continues at its current rate<i>\u00a0<\/i>for the next 50 years, the number of properties at risk of flooding will almost double.<\/p><p>It is therefore crucial that flood risk is assessed and managed appropriately during the planning, design, and construction of new developments.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a00e282 elementor-widget elementor-widget-text-editor\" data-id=\"a00e282\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><span style=\"color: #0a527a;\">GUIDANCE FOR FLOOD RISK ASSESSMENTS<\/span><\/h4><p><a href=\"https:\/\/www.gov.uk\/guidance\/flood-risk-assessment-for-planning-applications\" target=\"_blank\" rel=\"noopener\">Defra and Environment Agency guidance<\/a>\u00a0requires flood risk assessments (FRAs) to be submitted with planning applications for developments, including the change of use of existing buildings, that are within \u2018Flood Zones\u2019 2 or 3 (having a medium or high probability of flooding) on the Environment Agency\u2019s\u00a0<a href=\"https:\/\/flood-map-for-planning.service.gov.uk\/\" target=\"_blank\" rel=\"noopener\">Flood Map for Planning<\/a>. These zones encompass land that is likely to be flooded from rivers or the sea in a \u20181 in 1,000 year\u2019 flood event.<\/p><p>FRAs must also accompany planning applications for some developments that are within Flood Zone 1 (low probability of flooding), as follows:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-afdb9a3 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"afdb9a3\" data-element_type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Developments that are larger than 1 hectare<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Developments that could be affected by sources of flooding other than rivers and the sea (for example surface water, sewers, groundwater and infrastructure failure)<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Developments in areas that have \u2018critical drainage problems\u2019 (as defined by local planning authorities)<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0131ac1 elementor-widget elementor-widget-image\" data-id=\"0131ac1\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t<figure class=\"wp-caption\">\n\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"601\" height=\"400\" src=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Failure-of-Water-Retaining-Infrastructure.jpg\" class=\"attachment-large size-large wp-image-12854\" alt=\"\" srcset=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Failure-of-Water-Retaining-Infrastructure.jpg 601w, https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Failure-of-Water-Retaining-Infrastructure-300x200.jpg 300w\" sizes=\"(max-width: 601px) 100vw, 601px\" \/>\t\t\t\t\t\t\t\t\t\t\t<figcaption class=\"widget-image-caption wp-caption-text\">The failure of water retaining infrastructure<\/figcaption>\n\t\t\t\t\t\t\t\t\t\t<\/figure>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-953765e elementor-widget elementor-widget-text-editor\" data-id=\"953765e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>British Standard BS 8533:2017, \u2018<i>Assessing and managing flood risk in development \u2013 Code of Practice\u2019<\/i>, complements the Defra and Environment Agency guidance and gives recommendations and guidance on the appropriate assessment and management of flood risk to a proposed development. There are three main stages in an FRA, which are:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b87ab30 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"b87ab30\" data-element_type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Assess the probability and consequence of flooding to the development site from all sources.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Determine whether the development will increase the risk of flooding elsewhere.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"8.305\" height=\"15.142\" viewBox=\"0 0 8.305 15.142\"><path id=\"Path_185\" data-name=\"Path 185\" d=\"M0,0,5.536,7.572,0,15.143H2.768L8.3,7.572,2.768,0Z\" transform=\"translate(0 0)\" fill=\"#007aa3\" opacity=\"0.998\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Establish the design measures needed to manage the risk of flooding to the development (and elsewhere, if applicable).For example, constructing flood defences or providing dedicated routes for floodwater to pass unimpeded through the site without affecting buildings.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f75453 elementor-widget elementor-widget-text-editor\" data-id=\"7f75453\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><span style=\"color: #0a527a;\">WHY DO NEW DEVELOPMENTS CONTINUE TO FLOOD?<\/span><\/h4><p>Despite this guidance, we still see numerous situations where new developments flood (ranging from single houses to large scale urban regeneration projects), and property owners and insurers are left to pick up the pieces. In many of these cases we find that the risk of flooding has not been adequately considered or managed by those involved in the planning, design and construction of the new developments. Some examples of recent cases involving flooding of new developments for which we have provided forensic and expert witness evidence include:<\/p><p><span style=\"color: #0a527a;\"><strong>&gt;<\/strong>\u00a0<\/span> A small development in Flood Zone 1, but in an area known to be at risk of surface water flooding, as shown in the Environment Agency\u2019s <a href=\"https:\/\/check-long-term-flood-risk.service.gov.uk\/map\" target=\"_blank\" rel=\"noopener\">Surface Water Flood Risk Map<\/a>. An FRA was not prepared (but should have been, given the risk of surface water flooding) and no design measures were specified to manage the risk of flooding.<\/p><p><strong><span style=\"color: #0a527a;\">&gt;\u00a0<\/span><\/strong> A new basement extension in an area known to be at risk of surface water flooding. The flood risk assessment did not adequately consider the risk of surface water flooding to the basement (which subsequently flooded).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c5874dd elementor-widget elementor-widget-image\" data-id=\"c5874dd\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t<figure class=\"wp-caption\">\n\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" width=\"800\" height=\"532\" src=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Basement-prone-to-flooding.jpg\" class=\"attachment-large size-large wp-image-12855\" alt=\"\" srcset=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Basement-prone-to-flooding.jpg 903w, https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Basement-prone-to-flooding-300x199.jpg 300w, https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Basement-prone-to-flooding-768x510.jpg 768w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/>\t\t\t\t\t\t\t\t\t\t\t<figcaption class=\"widget-image-caption wp-caption-text\">Basements can be particularly prone to flooding if adequate flood protection measures are not incorporated in their design.<\/figcaption>\n\t\t\t\t\t\t\t\t\t\t<\/figure>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ca68b77 elementor-widget elementor-widget-text-editor\" data-id=\"ca68b77\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #0a527a;\"><strong>&gt;<\/strong>\u00a0<\/span> Flooding during construction of a new road that crossed multiple watercourses and floodplains. Inadequate consideration was given to the risk of flooding occurring during construction in the Risk Assessment and Method Statements (RAMS) prepared by the contractor.<\/p><p><strong><span style=\"color: #0a527a;\">&gt;<\/span><\/strong>\u00a0 Ground levels were raised in part of a development site that was at risk of flooding. This loss of \u2018floodplain storage\u2019 resulted in floodwater being displaced into nearby properties, increasing their risk of flooding.<\/p><p><strong><span style=\"color: #0a527a;\">&gt;<\/span><\/strong>\u00a0 Inadequate consideration was given to the likely overland flow path for surface water across external areas of a residential property, resulting in surface water being directed into (rather than away from) the house.<\/p><p><strong><span style=\"color: #0a527a;\">&gt;<\/span><\/strong>\u00a0 The specification of flood protection barriers across doorways to a building in a flood prone area, without considering other potential entry points for floodwater to enter the building (such as through airbricks).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63a4296 elementor-widget elementor-widget-image\" data-id=\"63a4296\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t<figure class=\"wp-caption\">\n\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" width=\"800\" height=\"532\" src=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Flood-protection-across-doorway.jpg\" class=\"attachment-large size-large wp-image-12856\" alt=\"\" srcset=\"https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Flood-protection-across-doorway.jpg 903w, https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Flood-protection-across-doorway-300x200.jpg 300w, https:\/\/www.hawkins.biz\/wp-content\/uploads\/2022\/10\/Flood-protection-across-doorway-768x511.jpg 768w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/>\t\t\t\t\t\t\t\t\t\t\t<figcaption class=\"widget-image-caption wp-caption-text\">A flood protection barrier installed across a doorway<\/figcaption>\n\t\t\t\t\t\t\t\t\t\t<\/figure>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0175e84 elementor-widget elementor-widget-text-editor\" data-id=\"0175e84\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The construction of a flood defence wall around a property adjacent to a river, with inadequate consideration of the potential for floodwater to bypass the defence by travelling through the ground beneath it. A basement extension with no measures to prevent water backing up from the public sewer and overflowing from drains in the basement.
